TERMS OF REFERENCE
Pre-Feasibility Study Mission for Support to
Basic Education Sector Programme in
Indonesia

DESCRIPTION OF THE ASSIGNMENT

Objective

1. Based on an analysis of GOI priorities for basic education, of its need for external assistance and of existing/foreseen development partners' support, the mission is expected to identify and appraise all options available for pro-poor education programmes for potential EC and AusAID support that would: (i) support GOI education goals priorities and the Millennium Development Goals (MDG); (ii) ensure added-value and strong performance results from EC and AusAID financial contributions; (iii) contribute to joint Government and development partners efforts to develop a sector wide approach and a sector support programme for the basic education sector; (iv) be in line with prevailing EC and AusAID policies, plans, regulations and guidelines; and (v) contribute to accomplishment of Paris aid effectiveness goals.

Scope

2. Building on existing analyses (see Annex 3 for a preliminary list) as well as works in progress by EC’s BE-SCSP2 and AusAID’s BEP/C-SAS, the mission will provide an overview of the education sector in Indonesia covering its current policy, policy reforms and strategy, and financing, as well as GOI priorities for donor support and needs for external funding in the education sector. The mission team’s analysis will be based on the EC’s “Seven Assessments Framework” which includes a detailed analysis of the macro-economic situation, the overall Public Finance Management (PFM) system, and ongoing reforms, as outlined in Annex 4.

3. Based on this analysis, the mission will review and outline all options and aid modalities available for EC and AusAID to support GOI priorities in education, to the extent possible in cooperation with the Netherlands, the World Bank, the Decentralisation Support Facility (DSF) and other interested donors.


4. The options for follow-on support to current EC and AusAID-supported programmes to be assessed include:
• extension or continuation of existing programs/support;
• support for the SISWA programme;
• support for a broader sector support programme;
• support to more specific interventions (such as the BOS scheme);
• sector budget support;
• support through a Trust Fund or other modalities;
• possible combinations of the above; and
• other potential options identified by the mission.

5. The value-added for each option should be assessed and fully justified, in the context of ongoing progress in decentralisation and reforms in PFM, progress achieved in strengthening capacity for decentralised sector-based management of education, as well as GOI policies on external aid management and GOI-donor policy dialogue.

6. An Option Appraisal Report will be prepared for each option assessed, taking into account relevance, feasibility, aid modality and timeframe issues. The report will give particular attention to: 1) readiness of the education sector and broader GOI policies and reforms; 2) the forthcoming elections and potential consequences (e.g. in terms of ownership, decision-taking, progress in reforms); 3) resource implications; and 4) the sequence and timeline of EC's and AusAID's respective procedures. Each reports is expected to be realistic and practical, not based on too many assumptions and/or expected trends, and will include a risk analysis and related mitigation strategies. The mission will identify areas that require further detailed analysis. The mission will also draft and prepare terms of reference for the subsequent phase of the programme design.

Proposed methodology

7. The team should consult extensively with involved GoI ministries and agencies, - MONE and MORA in particular, Bappenas, Ministry of Finance, Ministry of Home Affairs - in order to ensure full input into mission findings and recommendations . The mission should however communicate to GOI partners that the pre-feasibility phase does not constitute a commitment to further support from the EC or AusAID.

8. The team will also liaise with SWAp Facilitation team as well as the team engaged to review donor capacity building models (respectively AusAID and BEC-TF-funded), expected to be mobilised by August 2008. Field visits should be with relevant GOI and development partner representatives as, and should be set up in liaison with national, provincial and district authorities.

9. In addition to meeting the specific requirements of EC and AusAID, the mission is expected to work closely with other development partners, specifically the Netherlands and the World Bank, to ensure that the global objective of harmonisation is achieved to the greatest extent possible.

10. The team is expected to work collaboratively with GOI and development partner representatives and other consultants at all times, and to share information and analysis on an ongoing basis, avoiding duplication and providing added value to the work of all partners. Where there is a request for additional support from GOI, or development partners, the mission team is to discuss this with the EC Delegation and AusAID prior to agreeing to it.

11. Regular briefings with the EC Delegation & AusAID and with GOI and other development partners should be scheduled. Workshops/seminars to share and discuss findings more formally are to be delivered at least three times during the mission. The first workshop will be with the EC and AusAID; one workshop with GOI; and one for involved development partner representatives.

Required outputs

12. The team will deliver the following:

(i) An Inception Report, which should be submitted within five working days of the commencement of the assignment. This report will outline the scope, methodology (including allocation of tasks among team members) and process for the mission, as well as identify key stakeholders to be involved and activities to be undertaken. It will include a schedule for meetings with relevant parties and for field visits;

(ii) A Weekly Briefing to GOI, the EC Delegation, AusAID, and other involved development partners. Briefing notes could be in the form of emails, PowerPoint slideshows, or in hard copy depending on need. These may inform preparation of the final report in terms of process and programme development;

(iii) Option Appraisal Report for each of the options assessed. Each report should cover all requirements of the appropriate EC Identification Fiche (a sample is presented in Annex 5) and take into account AusAID’s Guideline for Concept Development (Annex 6);

(iv) Terms of Reference for field missions. This will define the timeframe, length, location and the expected outcome of field missions.

(v) Presentation/Discussion materials. These will be prepared for workshop/seminars to share findings and contribute to the work of sector programme support preparation overall.

(vi) The Final Report. This report will synthesize all findings, conclusions and recommendations, and include the analysis of the Seven Assessment Framework, a description of SWAp development and process to date, field mission reports, and notes of key meetings and discussions. The final report should be 40 pages in length (excluding Annexes), and include an executive summary. It should provide discussions on gender, partnership, aid effectiveness & relevant procurement issues, and also identify areas that require further detailed analysis. The report will incorporate all key documents produced by the mission as annexes, including the Option Appraisal Report for each option identified. The report will also provide terms of reference for the subsequent programme design phase. The Team Leader will propose the structure of the final report to the Mission Oversight Committee for review and approval.


Requested services

Procurement of services

13. Six international consultants are to be procured, as specified in the next section. The EC will recruit three consultants, namely: Program Support Design Specialist, Education Management Specialist, and Education SWAp Specialist.

14. AusAID will recruit three consultants, namely: Team Leader and as the Education Sector Governance and Institutional Reform Expert, Public Financial Management Expert, and Expert on Consultative Processes.

Team Profile

15. The profile of the team as a whole will include the following expertise, skills and experience:
- Solid and diversified experience in the specific fields of expertise needed;
- Experience with identification and appraisal of education programmes in the context of sector-wide approaches;
- Conversant with EC PCM approach and EC aid delivery methods, in particular EC Guidelines on Support to Sector Programmes;
- Conversant with AusAID corporate policy on quality reporting system and business process for aid delivery;
- Working knowledge of EC and AusAID development assistance procedures/regulations and policies;
- Experience in Asia;
- Experience of Indonesia decentralisation in education;
- Knowledge on gender, procurement, partnership and aid effectiveness issues;
- Knowledge and familiarity with the Paris declaration on aid effectiveness;
- High levels of professionalism and commitment to delivery of results; and
- Excellent report writing skills in English.

16. The composition of the team of experts should be balanced to enable complete coverage of the different aspects of the mission terms of reference (in particular, covering the requirements of the Seven Assessments Framework), including cross-cutting issues.

17. The Team Leader will be accountable for the quality of reports produced. The team leader will direct and manage the preparation, implementation, analysis and report writing of the mission and liaise with the GOI/EC/AusAID oversight committee. The team leader will be responsible for overall work planning and ensuring that each team member has responsibility for analysis and reporting on specific requirements and for coordination of reports meeting quality requirements in a timely fashion. More specifically, the team leader will: (i) lead the team in defining the scope and process of this mission during the inception period; (ii) define with the consultants the best assignment of tasks among team members, based on the qualifications and areas of expertise of each individual involved; (iii) follow up with all members regarding their timely delivery; (iv) provide direct technical support to team members on specific tasks; and (v) ensure the timely
finalisation of the reports and monitor the quality of outputs of each consultants.

18. Team members will work together with the Team Leader and all other team members to ensure mission objectives are achieved. They will carry out research work as assigned, contribute to the writing of the "Option Appraisal Reports" for each option; contribute to the writing of the draft final report and preparation of presentation materials that will facilitate the discussion of findings; contribute to the finalisation of the report after inputs have been received from GOI, EC and AusAID.

19. Further details of the division of work will be established during the inception period. While the expert consultants will have individually assigned tasks, it is expected that they will cooperate and work collaboratively as team members and especially with the Team Leader to ensure the coherence and quality of the end products.

Expert Profiles

20. EC will recruit experts with the following experience and knowledge:
Program Support Design Specialist, Category I
Education • Masters level, education or similar
Experience and knowledge
• Senior education expert with minimum 15 years of experience in development cooperation.
• Extensive experience in the design of major joint government-donor financing programmes in education in developing countries, including education SWAPs and programme support mechanisms, involving grant and loan financing.
• Experience with education sector analysis, education financing policies and strategies, and policy analysis.
• Experience with the advocacy, design and implementation of partnership processes, and of consensus-building among involved Ministries of Government and development agencies.
• Experience in a wide range of countries and with the procedures of several donors and lending institutions, including EC and AusAID.
• Experience with Indonesian education system an asset.

Education management specialist, Category I
Education • Masters level, education or similar
Experience and knowledge
• Senior education expert with minimum 15 years of experience in development cooperation.
• Experience in managing / supervising education programmes in developing countries, preferably in the context of SWAPs.
• Extensive policy level work on (basic) education in developing countries, as well as experience in pro-poor (basic) educational reforms, preferably in Asia.
• Experience with capacity development / change management, preferably in a decentralised context.
• Experience with quality education improvement issues.
• Experience with donor coordination.
• Experience with various development agencies.
• Experience with Indonesian education system an asset.

Education SWAp specialist, Category I
Education • Masters level, education or similar
Experience and knowledge
• Senior education expert with minimum 15 years of experience in development cooperation.
• Strong theoretical and technical background on aid effectiveness issues and Sector Wide Approaches, with exposure to SWAPs in a range of countries, including experience in harmonisation and coordination of donor contributions to (education) sector financing.
• Experience in capacity development on new aid modalities in general and education SWAPs more specifically (including budget support), both for donors and recipient governments.
• Experience with education sector analysis and reform processes.
• Experience with various development agencies, including the EC and AusAID.

21. AusAID will recruit experts with the following experience and knowledge:

• Superb communication skills, including timely completion of complex written proposals and reports that combine inputs from multiple sources and target multiple audiences
• Advocacy and negotiation skills that contribute to consensus-building among involved Ministries of Government and development institutions

Financial Management expert
Education • Masters level, public finance or macro economics
Experience and knowledge
• Senior education finance expert with at least 7 years working on public sector finance in developing countries, including in education sectors
• Experience with analysis/assessment of Public Finance Management systems and reforms
• Experience with budget support operations
• Experience of education financing in a decentralised system
• Experience & knowledge on anti-corruption mitigation and corrective measures (in education context).



Consultative Processes Expert
Education • Masters level, Politics, Government or similar
Experience and knowledge
• A minimum 3 years of experience in international/development cooperation
• Experience with design of consultation processes for consensus-building among involved Ministries of Government and development agencies.
• Experience in donor-Government consultations on sector support programs in at least one developing country
• Expertise/experience in communications and media
• Experience in the promotion of aid effectiveness principles
• Experience with an education system in Asia an asset

Working language(s)

22. The working language of this assignment will be English therefore a high level of written and spoken English will be essential for all experts. Since many of the meetings and much of the necessary information will be only available in bahasa Indonesia, translation and /interpretation services should be included in the budget if the experts are not fluent in bahasa Indonesia.


DURATION AND LOCATION

Duration

23. The assignment will start in-country on 6 October 2008. Each expert will have 30 working days, with an additional 10 working days for the Team Leader. For this mission, a six day work week is approved. Final report writing will be in home country (10 days for Team Leader; 3 days for other specialists). Total effort is 227 person days. The assignment is expected to have an overall duration of 3 months, and be completed by December 31, 2008. The table below presented the breakdown for EC and AusAID recruitments.

Location of assignment

24. The mission will be based in Jakarta, Indonesia and will include up to 3 field visits (exact locations to be decided in discussion with Mission Oversight Committee).

SCHEDULE FOR DELIVERABLES

25. All documents should be submitted in paper and electronic versions. The final Mission Report should be submitted with 3 hard copies and electronic version. The team leader should submit reports according to the following deadlines:

- The inception report - to be submitted to the EC Delegation & AusAID within 5 working days of mission commencement in Indonesia;

- An Option Appraisal Report for each of the option assessed (meeting requirements of the EC Identification Fiche and taking into account AusAID’s Guideline on Concept Development - should be submitted to the EC Delegation & AusAID at least 5 working days prior to the end of the in-country mission. The EC Delegation and AusAID will jointly provide comments on each draft report within 10 working days after receipt. The mission should incorporate comments from the Delegation and AusAID and should submit the final Option Appraisal Reports within 5 working days of the receipt of comments. The Delegation & AusAID will provide approval of the final reports within 5 working days following receipt;

- Presentation and discussion materials for at least 3 workshops/seminars (the EC and AusAID; GoI; and other relevant development partner representatives) – should be submitted and discussed with the EC Delegation and AusAID at least 3 working days prior to the workshops taking place;

- TOR and detailed plans for field missions – should be cleared in advance of travel by the Mission Oversight Committee;

- The draft Final Report (synthesizing all findings, conclusions and recommendations, including the analysis of the Seven Assessment Framework, a description of SWAp development and process to date, field mission reports, and notes of key meetings and discussions) - should be submitted to the EC Delegation and AusAID prior to departure. The Delegation and AusAID will provide comments on the draft report within 20 working days after receipt; and

- Final Report (incorporating comments from the Delegation and AusAID) – should be submitted within 10 working days of the receipt of comments, including the final Option Appraisal Reports approved by EC and AusAID. The report will also provide terms of reference (TOR) for the subsequent design phase. The Delegation and AusAID will provide the approval of the report within 10 working days after reception.


IMPORTANT REMARKS

26. A local budget available to the consultants must be foreseen in the financial proposals to ensure that the experts can function autonomously. The budget will cover all expenditures including such as interpreter services, local transportation for the field trips, as well as the costs of organising workshops. Local transport and office facilities (word processing, printing, copying, telephone/fax and internet facilities, etc.) will have to be arranged directly by consultants and will not be provided by any EC or AusAID office/ project. Each consultant is expected to have a lap top computer.

27. During all contacts with the Indonesian authorities, local stakeholders, or any project or organisation, the consultants will clearly identify themselves as independent consultants and not as official representatives of the European Commission or AusAID. All documents and papers produced by the consultants shall clearly indicate the number of the letter of contract and carry the following disclaimer: “This report has been prepared with the financial assistance of the European Commission and AusAID. The views expressed herein are those of the consultants and therefore in no way reflect the official opinion of the European Commission or AusAID”.

28. Selected consultants must possess passports with at least six month validity at end of the mission (therefore 9 months validity at start of mission) and obtain a valid business visa from relevant Indonesian embassies/consulate offices prior to coming to Indonesia, with sponsorship from the Delegation or AusAID, depending on the recruitment line, in terms of a Note Verbale to the relevant Indonesian Embassy.
